Terms of Service

Basic rules

1. The database service ‘Datanest of the Fair-play Alliance (hereinafter referred to as “Datanest”) is available to both the registered and unregistered users. The unregistered users do not have an access to the API Datanest (hereinafter referred to as “API”).
   
2. Registered users have an access to the API.
   
3. Registered user (hereinafter referred to as “user”) is the one who creates an account in the datanest.fair-play.sk and aggress with the terms of use (hereinafter referred to as “terms”).
   
4. The user has to use a functional and regularly monitored email address during the registration. ‘Regularly monitored’ for the purposes of this text means that the user will be able to respond to a potential email from the Fair-play Alliance (hereinafter referred to as “Alliance”) within two weeks, and this must not be an automatically generated email response.

Use of the web application Datanest

1. Use of Datanest if free of charge for both the registered and unregistered users.
   
2. Registration in Datanest is restrained to a specific user. User will not make the account available to the third persons.
   
3. Every user has an access to the Datanest database tables and a search engine.
   
4. Alliance can not guarantee the identity of the users and by no means takes responsibility for the content and accuracy of the posted comments.
   
5. User takes a responsibility for the comments they post in the Datanest system. User is required to avoid spam, advertising or marketing messages, and comments unrelated to the topic. It is also prohibited to post comments that contain vulgarism, promote xenophobia, defend or promote hatred, unreasonably attack other users or third parties, or otherwise violate morals and laws of the Slovak Republic. Alliance reserves the right to delete such comments at its own discretion.

Use of API

1. Use of API Datanest and API key is free of charge, though accessible only for the registered users.
   
2. API key is nontransferable. It may be used only by the person who activated the account.
   Data downloading via API is currently unlimited, though it is monitored. Excessive heavy loading of the Alliance server may become a reason for cancelling or limiting this service. Users of the API key who are interested in using the API in a way, which may cause heavy loading, shall contact Alliance via email address datanest@fair-play.sk beforehand, to ensure they will not jeopardize the general availability.
   
3. Users of the API key will notify Alliance of an existing application that uses data from Datanest and in case it is available online, the user will also inform of the web location of this application. If the application is not publicly available, the operator will give a permanent access to the Alliance upon a request. In case of an offline application, the user of API key will provide Alliance with the application’s copy and all of its other potential versions. API key user’s copyright to the application will not be compromised in this way.
   
4. API key user will upon request provide Alliance with monthly statistics (number of visitors and page views) for all the websites, which use data from Datanest. Alliance will not publish statistics obtained in this way, except when it receives consent from the operator. Alliance reserves the right to publish the usage statistics, which aggregate several (no less than 3) operators.

Use of data in Datanest

1. Alliance takes no legal responsibility for the accuracy, interpretation, or updating of data disclosed in Datanest and available via API. No liability can be raised against Alliance by a Datanest user for incurring potential damages from using Datanest, or related to data searching and their quality.
   
2. User takes into account that data in Datanest may contain errors due to a large amount of data processing at Alliance and at the public bureaus.
   
3. In case of a judicial trial regarding the Datanest data, in which Alliance gets acquitted by the court, Alliance will demand compensation for the damages and the other party contracts to settle the claim.
   
4. User will use the data disclosed in Datanest and available via API only with good morals. In case of differing opinions on meeting this condition, Alliance will attempt to reach an agreement with the user. In case an agreement cannot be reached, Alliance’s position will be decisive.
   
5. In case it is suspected that the disclosed data is inaccurate, the user will notify Alliance of this at administrator email datanest@fair-play.sk without undue delay.

License conditions

1. Databases disclosed in Datanest and available via API key (hereinafter referred toas “Databases”) are the property of Alliance.
   
2. Alliance gives consent to the free extraction and re-utilization of the content of the Databases or their parts for all territories of the world for duration of such rights under the following conditions:
   - Databases may only be used for purposes that are neither directly nor indirectly commercial
   - When using the data, the user shall attribute the rights ownership to Datanest of the Fair-play Alliance, and whenever possible, especially in applications using the API, as follows: “Rights to the database: 2010, Datanest.sk, Fair-play Alliance”. Whenever possible, the user shall hyperlink words Datanest.sk with http://datanest.fair-play.sk.
   - User may further distribute Databases and databases or other subject matters created with the Databases only under the same conditions.
   - User may not limit the use of the Databases and databases or other subject matters created with the Databases any more than it is in this license. For distributing the Databases and databases or other subject matters created with Databases the user shall always post a link to these conditions.
   
3. For any use of Databases, which does not comply with the license conditions stated above, it is necessary to obtain a written consent from the rights owner.

Final provision

1. In case of failure to meet the Terms, Alliance has a right to prohibit the user from accessing the Datanest and the key user from accessing data via API. Alliance takes no liability for any potential damages, which may be incurred by the user in this manner.
   
2. Alliance may change the Terms unilaterally. Alliance will notify the registered users via email or on the web address fair-play.sk no less than 2 weeks prior to the change.
   
3. Any potential change of Terms will be made by Alliance with aim to make the data on the management of the country as widely available as possible.
   
4. Service may be terminated at any time at Alliance’s discretion.
